What is a Deputyship?

A Deputyship is a legal arrangement where the Court of Protection appoints an individual (or individuals) to make decisions for someone who lacks mental capacity. This includes both financial decisions and health or welfare decisions.

The Court will carefully assess the circumstances before granting a Deputyship, and there are ongoing responsibilities for the appointed Deputy to manage the individual’s affairs.

At Heppenstalls, we help guide you through every stage of the Deputyship process, from the initial application to the ongoing duties you may have as a Deputy. Whether you’re seeking to manage your loved one’s finances, healthcare, or general welfare, we’re here to ensure you have the support and advice you need.

Why Deputyships Matter

Securing a Deputyship ensures the right person has the legal authority to step in and make decisions in the person’s best interests. This can help avoid confusion and stress during an already challenging time. We’re here to help you:

Take on legal authority
With a Deputyship, you’re granted the legal right to make critical decisions on behalf of someone who lacks capacity.
Manage finances and wellbeing
Whether it’s managing finances, making health decisions, or ensuring general welfare, you’ll be able to act on behalf of your loved one in a lawful and structured way.
Avoid disputes and conflict
Having a formal Deputyship in place helps avoid disagreements within the family by clarifying roles and responsibilities.
Secure the best interests of your loved one
We help you make decisions based on the specific needs of the person you’re acting for, with full legal support throughout.
