Real life problems and the solutions – Is probate required ?

Mrs D came in to see us as her husband had just passed away. In his Will he had left everything to her. Most of their assets were in joint names such as their main bank account, a shared savings account and their home. Mr D did have some savings and shares in his sole name. Mrs D was unsure if she needed to obtain a Grant of Probate or not.

It was explained that the joint assets passed to her by right of survivorship. The savings and shares however were of value that would require Probate in order to have them released to her.

Mrs D already knew the date of death valuation for the assets. She felt confident in being able to gather in the assets herself she was just uncertain with regard to the probate application itself.

We therefore offered to prepare the paperwork for the Probate application for her for a fixed fee. We also prepared the paperwork for the Land Registry to change the property into her sole name.

Everything was completed within 8 weeks and Mrs D was then able to have access to the bank account and shares in Mr D’s sole name.
