If documents need to be sent or used abroad, they often need to be what is called “notarised” by a Notary. A Notaries are one of oldest branches of the legal profession, originating in the Roman Empire.  Notaries are appointed by the Court of Faculties and are regulated through the Faculty Office of the Archbishop of Canterbury.

The rules which affect Notaries are very similar to the rules which affect Solicitors. They must be fully insured and maintain fidelity cover for the protection of their clients and the public. Our insurance is limited to £1m. Fees are calculated on the time spent dealing with the matter at the hourly rate of £300.00. The minimum fee is £75. They must keep clients’ money separately from their own and comply with stringent practice rules and rules relating to conduct and discipline. Notaries have to renew their practising certificates every year and can only do so if they have complied with the rules. The signature and seal of a notary public is recognised virtually throughout the world.

There are very specific requirements for the notarisation of a document, including verifying the person’s identity, their capacity and authority to carry out a transaction, their understanding of it and their wish to be a party to it.
