Contesting a Will
Heppenstalls offer a Fixed Fee service for assessing the merits of contesting a Will. For a fixed fee of £1200 (including VAT), we’ll complete an in-depth assessment of your case, and advise you if you have grounds for a claim or not.
There are several grounds for contesting a will including:
- Lack of proper formalities
- lack of testamentary capacity
- lack of knowledge and approval
- undue influence and fraud.
We will arrange a meeting with you to gather all the facts. We will then investigate the circumstances and if appropriate obtain the deceased’s medical records and review them, as well as speaking to any witnesses who can assist. It may be necessary to send a letter to the person who prepared the Will to ascertain the facts (a Larke v Nugus letter) and this is also included.
We will prepare a formal written assessment for your consideration and you can decide whether or not to proceed further.
